The right to request divorce in order to terminate the husband and wife relationship is a personal right attached to the moral right of the husband and wife. Only husband, wife or both husband and wife have the right to request divorce, except in some other cases such as one of the parties is mentally ill or unable to perceive or is the victim of violence, the father, mother or relatives have the right to ask the Court for a divorce.

1/ Limiting of divorce rights for husband in Vietnam

Vietnamese law controls divorce by providing a number of provisions restricting the right for husband to divorce. The regulations on the right restriction for husband have the following provisions:

• The husband has no right to request a divorce in case the wife is pregnant, giving birth or raising a child under 12 months old
• In case the wife is pregnant, giving birth or raising a child under 12 months old but not the child of husband, the father of the child can not be identified, the husband is still not entitled to request the court to resolve the issue
• If a woman is surrogate for another person, in principle the woman is still considered to be pregnant and the husband has no right to divorce

Note: However, this provision only limits the right for husband to divorce. That is, if the wife files for divorce, even though she is pregnant or raising a child under 12 months old, the court will still accept and handle it like other normal cases.
